Terms of service
The agreement between your business and ours. Written to be read once and understood, rather than to be impressive.
Who this is between
These terms are between I-Sixty Group ("we", "us") and the business that subscribes to Tenvar ("you"). Full company details are on the contact page.
By using Tenvar you accept these terms. If you are accepting them for a company, you confirm you are authorised to bind it.
What the service is
Tenvar is a hosted site-costing system. It lets your people record labour, plant, fuel, materials and other costs against a site as they happen, and it reports what each site has cost. It is provided as a service over the internet; there is nothing to install on a server, and the phone side installs from the browser.
We may change and improve the service. If we remove something you rely on, we will tell you before we do it.
What it is not
Tenvar produces management information, not financial statements. The figures are only as good as what your people capture and the rates you load. Nothing in it is accounting, tax or legal advice, and it does not replace your accountant, your auditor or your obligations to SARS.
The leave register applies the Basic Conditions of Employment Act's accrual rules as we understand them, and the payroll extract splits overtime on the ordinary 1.5× basis. Both are a convenience. Checking that what you pay is what the law and any bargaining council agreement require remains yours.
Accounts and PINs
- You decide who gets an account and what role each person has.
- PINs and passwords are stored only as hashes. We cannot retrieve one; a forgotten PIN is reset by your own office.
- Site phones are often shared. Keep the roster current — an account left active for someone who has left can raise a purchase order in your name.
- You are responsible for what is done under your accounts.
What it costs
R 4 800 per month includes up to twelve active sites and unlimited users. Each further block of six active sites, or part of a block, is R 2 000 per month. All prices exclude VAT.
A site is active while you are still recording cost against it. A site you finalise stops counting from the day it is closed, and stays readable indefinitely. Your monthly charge is worked out on the number of active sites during that month.
- Billing period
- Monthly in advance, unless we have agreed otherwise in writing.
- Payment terms
- Available on request
- Refunds
- Available on request
- Price changes
- We will give at least Available on request written notice of an increase. If you do not accept it you may cancel before it takes effect.
- Late payment
- If an account is unpaid we will contact you before restricting access, and we will never delete data over a late invoice without telling you first.
Your data
Your data is yours. Sites, costs, employees, suppliers, documents — all of it belongs to you, and nothing in these terms transfers ownership of it to us.
You grant us the limited right to store and process it for the purpose of running the service for you, and for no other purpose. We do not sell it, we do not mine it, and we do not use it to train models. Where we use another service to run part of the system, it is listed in the privacy policy.
Personal information in the system is mostly your employees'. You are the responsible party for it under POPIA and we are the operator. Telling your staff that the system exists and what it records is your obligation, and a fair one — they are the people it is about.
You may ask for an export of your data at any time while the subscription is running, and Available on request after it ends.
Availability
We aim to keep Tenvar available at all times and we will not pretend to a guaranteed uptime we are not yet in a position to back. There is no service-level agreement unless we have signed one with you separately.
The part that matters most on a site is designed not to depend on us being up: captures are written to the phone first and sent when they can be. A period where the server is unreachable delays a figure reaching the office; it does not lose the capture.
Planned maintenance that will interrupt the service will be announced beforehand where we reasonably can.
Acceptable use
Do not:
- use the service unlawfully, or to hold information you have no right to hold;
- try to break into, overload or reverse-engineer it;
- resell or sublicense access without our written agreement;
- upload malicious code, or content you do not have the right to upload.
If something is being done that puts the service or other customers at risk, we may suspend the account. We will tell you why, and we will restore it as soon as it is resolved.
Ending the agreement
The subscription runs month to month. You may cancel at any time by telling us in writing at sales@tenvar.co.za, effective at the end of the month you have paid for. There is no lock-in period and no cancellation penalty.
We may end the agreement on Available on request written notice, or immediately for a material breach that is not put right after we have asked.
If you are a consumer within the meaning of the Electronic Communications and Transactions Act and it applies to your subscription, nothing here limits the cooling-off right that Act gives you.
Liability
We will do our work with reasonable skill and care. But Tenvar reports figures that your own people capture, and a decision you take on those figures remains your decision.
To the fullest extent the law allows, we are not liable for indirect or consequential loss — lost profit, a mispriced tender, a contract lost or won — and our total liability in any twelve-month period is limited to the fees you paid us in that period.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or anything the Consumer Protection Act prevents us from excluding where it applies.
Changes to these terms
We may update these terms. If a change materially affects you we will tell you before it takes effect, and the date at the top of this page always shows when it last changed. Continuing to use the service after that means you accept the change.
Governing law and disputes
South African law governs this agreement, and the South African courts have jurisdiction.
Before anyone goes to court: write to us. Almost everything is resolved by explaining how a figure was arrived at. If that fails, we will agree in good faith to mediation before litigation.
